Welcome to Inkwell. These Terms of Service ("Terms") govern your use of the Inkwell website, studio, and marketplace (collectively, the "Service") operated by [Legal Entity Name] ("Inkwell", "we", "us"). By creating an account or using the Service, you agree to these Terms.
1. Accounts
You must be at least 13 years old (or the age of digital consent in your country) to use Inkwell. You are responsible for the activity under your account and for keeping your credentials secure. Notify us immediately at hello@inkwell.example if you suspect unauthorized use.
2. Creator Terms
You retain ownership of the characters, worlds, story arcs, and comics you create using Inkwell ("Creator Content"). By publishing Creator Content on Inkwell you grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it as needed to operate the Service and promote your work.
You represent that your Creator Content does not infringe third-party rights, does not violate our Acceptable Use Policy, and that you have the right to sell it if you enable paid distribution.
AI-generated imagery: images produced through Inkwell's generation tools are assigned to you subject to the model provider's terms. You are responsible for ensuring the prompts you submit and the outputs you publish comply with applicable law.
3. Buyer Terms
Purchases of paid comics grant you a personal, non-transferable license to read the comic through your Inkwell account. You may not resell, redistribute, or extract the underlying files.
4. Revenue Share
- Free plan creators: Inkwell retains a 3% platform fee on each sale (in addition to payment processor fees).
- Inkwell Pro creators: Inkwell retains a 0% platform fee.
- Payment processing fees are charged by Stripe and deducted separately.
Payouts are handled by Stripe on the schedule you configure in your Stripe account. You are responsible for any income tax obligations on your earnings.
5. Refunds & Chargebacks
See our Refund Policy. Chargebacks initiated with your card issuer may result in loss of access to the purchased comic and are subject to Stripe's dispute process.
6. Subscriptions
Inkwell Pro is billed monthly or yearly and renews automatically until you cancel. You may cancel any time in your dashboard. Cancellations take effect at the end of the current billing period. We do not prorate refunds for partial periods except where required by law.
7. Prohibited Content & Termination
You may not use Inkwell to create or distribute content that violates our Acceptable Use Policy. We may suspend or terminate accounts that violate these Terms, at our discretion, and remove content that we reasonably believe is unlawful or infringing.
8. Disclaimers
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Inkwell disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, Inkwell's total liability arising from or related to these Terms will not exceed the greater of (a) the amounts you paid to Inkwell in the 12 months preceding the claim or (b) USD $100.
10. Governing Law
These Terms are governed by the laws of [Jurisdiction], excluding its conflict-of-laws rules. Disputes will be resolved in the courts located in [Jurisdiction].
11. Changes
